To those who subscribe to the modern dogma of Economics, please brace yourselves for the following.

I was playing Monopoly® with a child the other day. Although there were no questions about play from the four-year-old, I was curious to actually read the instruction to a game we usually played off-the-cuff.

Interesting to find that it was based on a wholly unsound understanding of economics, to the point where I can call it naive. It's merely a game, but look at some of the game-scoped tenets:

1. You can only borrow from the bank, and
2. The bank never goes bankrupt.

I get the point.

I mean, the point is that everyone shall be dependent on the bank for exigent funds, or any funds. And, well, the banker can resort to making negotiable money out of scraps of paper.

As the child was buying everything in sight, and then mortaging those holdings to buy something else, I thought about a scenario similar to the free money concept...

...the Star Name certificate.

I'm surprized that anyone would expend one-half to two hours of their labor (quite a bit more if they desire the spiffy parchment) on a printed piece of paper, but TV commercials do not pay for themselves.

Sure you could ask a middle school-aged child (or a four-year old) to lookup arbitrary coordinates of a star and design a certificate, and print their work at Kinkos or any drug store for less than 0.0009 ounces of gold (value of today's dollar). Or you could grab one from Free Name a Star.

But that is not the point. The significant point is that if that Star Name certificate were forced on you by a bank to use as currency, then, as a good friend, I advise you expend many hours of your labor in buying stock or private equity in the businesses behind the following websites because they have unlimited potential:

Better than that, we all ought to start printing our own Star Name certificates before the Gov'ment (not that one, the other one) monopolizes it (no pun intended) because there's gold in them 'thar papers!

Hmmm... on second thought, maybe this post is not as offensive to those who majored in the study of Economics.

Oh yea, if you didn't catch the similie between unbacked United States Dollars and unbacked Star Name certificates, then, well, now you did.

But that similie justly begs the question, "Is Monopoly only a game... or is inflation really money?"

Crap. There's the word my Economized friends find so offensive from my mouth: inflation. My apologies?

Also, for your edification only, with the honest money of old, 0.0566 ounces of gold was synonymous with one dollar. You can check for yourself, but that's not a huge difference between now and then if you print the money, or ... the ... Star Name certificates. Now I'm lost, what was the point?

I think it was to figure if I ought to expend my tangibly valueless money, on their tangibly valueless Star Name certificates. Sounds quid pro quo to me.

The practical distinction: Direct versus Indirect

Introduction

Have you ever paid a direct tax? What about an indirect tax? Are you a little fuzzy on the difference? If you've worked within the several States included in the Union styled the United States and outside of the black-market, or you own real property within that Union, I assure you that you've paid, or been harassed about, a direct tax. If you sell anything for a living, you've paid, or been harassed about, an indirect tax. I cannot think of a thing, except secondary-market sales like yard sales, that is not taxed. This article will help you understand the difference between the two modes of taxation, which, as you can tell by their yin-yang naming, are exhaustive but distinct like direct sunlight and indirect sunlight. And this article will wipe away the fuzziness on the taxation part of your brain by giving you tools to help you discriminate between the two modes of taxation, real-time.

But let us first consider the purpose of taxes. According to Noah Webster a tax is

A rate or sum of money assessed on the person or property of a citizen by government, for the use of the nation or state.

Additionally,

A tax consists of a man, a subject and a measure.

A man, both the male and female variety, is one upon whom the tax is levied.

A subject is something the man must do or possess in order for the tax to apply.

A measure is the thing against which the tax rate is applied.

Note that the subject is determined with respect to on whom the tax is laid, the man.

For example, one Federal Reserve Note (FRN) per couch (the subject) you own (the man), or ten per centum of the gain by another (the man) in FRNs derived from distilling spirits (the subject).

Exciting! Taxes exist not to punish, not to steal, but to support government in the strict sense: that is, a justice-oriented government. Unfortunately, when wielded by a non-justice-oriented government the effect is a catalyst for lower or stagnant standards of living for all men, both the male and female variety.

Still, a just government may be worth supporting, and the founders of the several States, who joined together to form this Union, intended that the government of that Union be just. To this end, they used the two exhaustive taxation modes, direct and indirect, to impose justice-oriented restrictions on each mode. Let us learn the distinction between a direct tax and an indirect tax, but keep in mind that the subject is the distinguishing factor.

Modes of Taxation: Direct

Direct taxes are all burdens imposed immediately upon the person or estate of the citizen; thus a tax upon houses, lands, money, wages of labor, etcetera is a direct tax.

A heuristic is that, a direct tax is either not avoidable or not shiftable or both.

Modes of Taxation: Indirect

Indirect taxes are the burdens imposed upon articles of consumption; thus, the revenue, or duty levied upon the sale of each gallon of gasoline, each ten-gallon hat, etcetera is an indirect tax.

A heuristic is that, an indirect tax is both avoidable and shiftable.

Modes of Taxation: Juxtaposition

The difference between the two modes of taxation is this: direct taxes act directly upon the person and property of the citizen (not shiftable), and is independent of his will (not avoidable); indirect taxes, by being imposed upon articles used in consumption (shiftable), leave the people at liberty to pay them or not (avoidable), by using or not using the articles upon which they are imposed. Thus, neither can a farmer, although making no sales, avoid the payment of a tax levied upon his land, nor a worker avoid the payment of a tax levied upon his wage property, but both may avoid the payment of the duty upon coffee and gasoline, by not using either.

In tabular form,

Note about direct taxes in above table: it follows that "forced enterprise" and "voluntary slavery" are contradictions, that is, they do not exist in nature, hence, the arrows.

Note about indirect taxes: a tax on the inventory of a business is a direct tax (like a tax on a home owner's home or a farmer's crops), hence the indirect tax is created by the sale-transaction, and cannot be imposed before that transaction occurs; that is, the indirect tax cannot be assessed before the sale.

Informally, some indirect taxes have the same effect as direct taxes. For example, a tax on the sale of necessities-to-life, such as raw food, gas to heat your home and power your transportation to work, and labor is like a tax on hunger, keeping a warm home, the liberty to find life sustaining work, and wage property, respectively, all of which are direct taxes because they are neither avoidable nor shiftable.

According to the above table, formally speaking,

What mode of taxation is used when you are taxed where the subject is wages from your labor and the measure is a percentage of the amount of wages?	Answer.
What mode of taxation is used when you are taxed where the subject is the sale of your labor and the measure is a percentage of the amount of wages?	Answer.

The Take Away

Now you know that the mode of taxation is determined by its subject and upon whom the tax is levied. Examples are, the tax is levied on the store owner's (the man) gasoline sales (the subject), and the tax is levied on the laborer's (the man) wages (the subject), as opposed to the sale of one's labor (the subject).

Next time you run up against a tax, determine on whom is it levied and what is the subject (your property→assessed after you own it→direct, or the sale of a consumable object→assessed as you sell it→indirect), and you will know whether the mode of taxation is direct or indirect.

You may not have noticed, but Ignorance rules the United States; and, if you have not yet discovered, Ignorance is not bliss, unless you lack all common Sense (i.e., no sense of: smell, taste, sight, hearing, touch; do not confuse your common Sense with simple Reasoning).

So you know, the American Insurance Group (AIG) executive-bonus-pay Bill expresses a blatant unapportioned Tax of a direct nature. As you may know, unapportioned direct Taxes shall not be imposed by the United States within the several States included in the Union.

Aside from the unlawful tax policy, we hear (see Congressman Ron Paul: Ex Post Facto Bonus Bill is “Unconstitutional” and “A Gross Distraction”) that the bill is also passed ex post facto. As you may know, the United States shall not ex post fact legislation. This is a tough call, because when the present income tax first debuted around 1913, if we recall correctly, it was held that an end of year Assessment that included statutory income accrued before the Bill was passed during that Year was not ex post facto.

Another attribute of the Bill, we have heard, is that it is a bill of attainder. Again, as you may know, no bill of attainder shall be passed by the United States. See Congressman Ron Paul: Ex Post Facto Bonus Bill is “Unconstitutional” and “A Gross Distraction”, Bill of Attainder 1 and Bill of Attainder 2. We are not sure of the Bill being an attainder, because it does not adjudge, without trial, a Man (including the male and female variety), or group of Men, guilty of a crime described in the Bill and, thereby, impose the requisite criminal penalty. If the Bill is somehow an attainder, then all income taxes of a direct nature are an attainder, which would practically nullify the constitutional direct taxing Power.

Given that your Congress, generally, and President do not comprehend the Constitution for the United States of America (particularly its taxing provisons) enough to comport their actions with it, do you still trust your and our Liberty under their Administration?

To answer our question, AIG is the segue that Congress uses to unlawfully act. An ex-president, F. Roosevelt, is credited with saying that, "in politics, nothing happens by accident." Whether those in Congress unlawfully act under ignorance or with knowledge, is irrelevant and does not appease our concern, does it appease yours?

We advise you to act like a Citizen and personally ensure your and, consequently, our Liberty.

Oh, and, since we are all invaluable, we, personally, think that we are all too big to fail; but, although we have not billions of dollars of fiat Currency to save everyone, we may have the knowledge conducive to a sound economy and practical government, so everyone has no barrier to save themselves.
The only issue with AIG is that they are inept investors of fiat Currency; but that is it: their business acumen is not trustworthy. Yet, they were able to convince the previous Administration that they deserve several billion dollars of fiat Currency. Given that you are a competitor or not a competitor to AIG, would you have loaned your fiat Currency to the practically insolvent AIG? We are guessing not; we suppose, like us, you would instead desire to invest in the honest owner of the auto shop down the street.
It goes to show how 'liberal' (see Liberal today equates to Plunder) a Man gets when they do not have to dispense of their own fiat Currency.

Liberal vs Conservative Philosophy

When you see the word Liberal used in politics, you should, in all propriety, read 'one who plunders.' To better explain, here is a definition of the word liberal from Webster's 1828 Dictionary:

1. Of a free heart; free to give or bestow; not close or contracted; munificent; bountiful; generous; giving largely; as a liberal donor; the liberal founders of a college or hospital. It expresses less than profuse or extravagant.
2. Generous; ample; large; as a liberal donation; a liberal allowance.

Notice that the theme is that you give much of yourself, but, in order to give, you must possess, and, in order to possess, you must exchange the fruit of your labor. Yet, the Liberal political philosophy has nothing to do with giving of the fruit of their labor; rather, it deals with plundering (taking from) as much possible of the fruit of the labor of others in order that they may act generous.

Just because a thing, in this case, plunder, is called outside of its name, it does not transform that thing into something else, in this case, liberal.

An example that I like is,

How many legs does a horse have?
If I call the horse's tail a leg, then how many legs does the horse now have?
The answer is four, not five; changing the name of a thing does not alter one physical characteristic about that thing.

Effect of Inflation

While speaking with a friend the other day, I heard her say that she shouldn't attend a dinner paid for by her friend. I asked why, and she said it was due to the hard times. Although it turned out that she desired to purchase a dress for the event, I was shocked to hear about "hard times" from her. With the overwhemingly positive reaction to more inflation, up until now, I thought that only I noticed the "hard times." Oddly enough, although she, the following folk, and many more notice the hard times, they still overwhemingly vote in favor of the cause of their spoil, that is, inflation. I assumed that people knew the cause of inflation and the effect of price increases beyond what the general population can afford. I find it interesting that, since they do not know their oppressor, they welcome it with open arms. Well, you could have bowled me over with a one dollar denomiated Federal Reserve note!

On a similar note, the greatest contributor to inflation is bank credit. I thought it amusing that, although the banks, as they are wont to do, created the mess, they try to wipe the egg off their face by offering variable interest rates to the less affluent. All know that you cannot pin down a budget when your interest rate could double overnight.

Not only do banks steal from your account by affecting the market with inflation and effecting price increases, but they protect themselves from their devaluation of the one dollar denomiated Federal Reserve note by also leaving room to take more from you who can least afford by variable interest rates.

Behind the advertised facade of your "friendly bank" lies economic ignorance and plunder. With friends like these...

p.s. I didn't explain how the general Government illegally enables all of this through legal tender, but enough for now.

It is not only inept fund and business managers that make your currency go *poof*: inflation, too, gives you pennies on the dollar.

I turned 70 years old in October 2007 and decided it was time to retire. I expected that the earnings from my investments in "safe mutual funds" would provide me enough income to cover my living expenses with a little travel money left over to make a couple of visits a year to see my grandchildren. Through no fault of my own, I have lost nearly half of the money I had just a few short months ago. I'm hoping to find a job, but so far no luck. Even if I do find something, I'll feel guilty about taking a job from a parent who may have lost theirs in the economic downturn. As a citizen who pays all the taxes I owe, and who sacrificed to save for my retirement, I am extremely angry about the greed and corruption that robbed me of a decent retirement. I pray that President Obama will find the strength to be successful.

Ohioans are no stranger to economic hardship. Since 2000 our work force has shrunk by nearly 8%. Those who do have a job are earning less than they did in 2000. My husband and I were small business owners. Two battles with cancer have drastically altered our lives. Healthcare costs account for 50% of our budget. We worry that we will not have access to lifesaving treatments when we need them most. My family urgently needs a quick response to the great economic challenges we face.

I was able to hold several jobs thanks to the wonderful supervisors at my company who saw a single mom willing to do anything to keep an income and health insurance for her child. Over time I lost all of them. Without help, my child will suffer. We need help and creating and saving jobs will keep me in my home and with my child. I felt sick for those with foreclosed homes, losing their jobs, but I was not living it. I didn't have a clue. To the people who are in the same situation or worse: I'm so very sorry, keep your chin up and tell your story even if you are not good at things like this. I'm not. Learn what you can about politics and this package as I am doing. Together we all can all make a difference. Let's get back to work.

My husband and I both are self employeed and have been struggling for quite some time now. We are luckier than most as we saw this coming and sold our house, took the equity from it and bought a mobile home with cash about 5 years ago. We drive old cars, but have no car payments. We have already dropped the insurance on our mobile home when it skyrocketed after the hurricanes here in Florida. We are about to have to drop our health insurance, as our income is declining from our businesses. You know, we have always worked. We have always paid our bills. We have always obeyed the laws. We have never taken anything that wasn't ours. We have never accepted charity. We never expected anyone to help us. All we want is a good economy where we can make our own way. Guide us in that direction, and the American people will do the rest!

I am a teacher in Florida where we are 50th in the country in spending per student. I feel this generation of students is being cheated out of a quality education. I'm fortunate that I have a job. But our education system is failing our childen. There are so many areas of education that are suffering because of massive budget cuts. The bottom line is: as the United States of America we can do better for our children. We MUST do better for our children. I have faith that President Obama will not let this continue and will actually make education a priority. I also know we have to be patient. I hope the stimulus plan will be passed so America can move in a positive direction.

I am a small-town pastor and my job is probably secure, at least unless our local farmers and teachers can no longer support a church. My pension fund has been drastically reduced so my retirement is ever more remote; I am 69 and can continue to work. However, my son, who is self-employed, is having a terrible struggle. He has no health insurance and no retirement fund. My daughter and son-in-law, like my son, have been self-employed and are now without permanent work because the company they contracted work with is sending most of their work to India. My nephew will probably lose the family farm (3rd generation) because of rising costs and decreasing income from farming. That said, we all support President Obama and trust that his administration is doing all they can for the economy and for our troubled relationships with the rest of the world.

Herring v United States: Due Process Denied

Just when you thought you were safe, the majority of Justices of the supreme Court of the United States vote that you were too safe: that is, you do not have the benefit of law when due process is violated. You should read that as, "there is no due process."

And that is not the half of it: in reading a little of the opinion (here found at SCOTUS Wiki), you will find that the arresting officer, Anderson, was not given authority to arrest Herring; instead acting on word of mouth (read, "I have a certified copy of neither the arrest warrant issued by a magistrate within this jurisdiction, nor a search warrant issued under oath of a third-party") and putting his neck on the line. Anderson, taking the law into his own hands, is personally liable and is subject to a trial for malfeasance.

The Judges think that Anderson "acted in good faith reliance on a warrant." How can that be the case when he never had a valid warrant under which he could act in good faith? The opinion references the 1984 case United States v Leon, 468 U.S. 897, writing evidence obtained on a warrant issued without probable cause is admissible. Even the magistrates issuing the warrant do not perform their job in investigating the substance of complaint or information, only issuing warrants based on adjudicable probable cause.

Would you like to be subject to an unlawful arrest, search and seizure, and then have no recourse to lawful behavior because some Judge says that lawful doesn't apply to your kind? If you let the majority of Justices of the supreme Court answer for you, then you're excited, raptured even, by the thought. Well, I'm not.

If you, citizen, do not draw the line at Justice, then, as you can read, the politicians and judges will draw it all over your face :-) Need I write that if you respect not yourself, including your rights, then others will find it difficult to respect you: and what kind of example is that, leaders of political freedom, to extend to our brothers in communist Lands?

Also, as people tend to get hung up on the Bill of Rights presented in the constitution for the United States. All you need to remember is that, unless the contrary appears in that instrument, then it is your right. Deny searches without valid warrants issued by a maginstrate of proper jurisdiction on the oath or affirmation of a third-party, and do not acquiesce and prejudice yourself when not under arrest. One could infer from this opinion that the supreme Court of the United States does not function to unequivocally protect your rights, but to meet arbitrary quotas.

This opinion is a very good example of why you should always eschew cud: especially after you become a judge!

Prelude:

My mode of operation is to study and Reason first, to expound to others and look for contradictions. I accept direct attacks on the merits; I dismiss collateral attacks (for example, ad hominems, or use of an argument to affirm a conclusion which does not follow therefrom).

Be respectful of yourself and others, and you will be respected. The truth is good to all who are honest, so there is no reason to fear, only reason to embrace, an open discussion, such as this, in search of truth. Speak up, rebut, refute and give approbation where due.

I define "cud" as being something that is masticated and magically passed through the bowels; that is to say, feces. If you know nothing about the process between mastication and the moving of bowels, then you tend to focus on the conclusion of the matter, the feces, and you derive great comfort in knowing nothing and in your playing in feces.
I care not if you have a certified copy of a conclusion made by God; if it doesn't contain the reasoning by which such conclusion is reached, and if you cannot honestly reason to it for yourself, then do not bother introducing it because you will be interrogated to support it: so, get yourself wisdom first (it is free and it is what God uses too!) and make an attempt to figure the why. For without reason, the conclusion of another is just fecal matter.

In other words, cud is conclusion without your reason, do not use cud: reason or make the reason of another honestly your own.

On that note, bring all of your honest and weighted reasoning; I care not if you cannot find references of others in support of it.

In summary, add zest to your conclusion by your reason; and mind holding me to the same vigor.
